Florida Sales Tax Audit Attorney
What is a reverse tax audit?
If you hear the words "Florida tax audit" it can be reason for immediate concern. There is a circumstance, however, where an audit can pay large dividends to a business owner. A reverse tax audit, done by a knowledgeable Florida tax professional, is performed to determine if there have been overpayments of Florida taxes. These are the types of refunds that a Florida Department of Revenue agent may never even mention to you. Whether initiated during a Florida DOR audit or as a completely separate engagement, a Florida reverse tax audit could spell big refunds for your company or your client's company.
Many of our clients believe that they are not overpaying Florida taxes, as least until they allow us to review their records. Since a reverse tax audit performed by our firm is often done on a CONTINGENCY FEE basis, our clients see no harm in letting our experienced attorneys review they records under attorney client privilege and we regularly, if not always, find overpaid taxes. We refer to this as "being broken and not knowing it." These clients are ecstatic when the refund check arrives.
If you have overpaid on taxes, it may be due to concerns over audits, penalties and interest which occurred in the past. At times, a business will over react in an attempt to prevent a tax liability in the future. Commonly, sales tax is charged on items which are actually exempt. In some cases, failure to claim valid exemptions, through misunderstanding the laws or carelessness, can cause taxes to be paid that should not have been. Other times, a business's tax software is just not sophisticated enough to account for all the intricacies of the ever changing Florida tax laws, administrative rulings, or case law, especially for Florida sales and use taxes. Other items the software is merely complying with what the Florida Department of Revenue is saying the "law should be," when the DOR's position directly conflicts with the law. In these later cases, we can challenge the Department of Revenue's position to your company's or your client's benefit.
No matter the cause of overpayment, the end result is the same and much needed funds will have been needlessly spent. Our firm focuses primarily on resolving serious tax problems. However, we also work to prevent them with our state tax planning and consulting services. We have been practicing law for over 30 years and have worked even longer as CPAs. With our experience and energetic attitude towards your tax concerns, a skillfully done reverse tax audit may provide an unexpected boost to your business. Occasionally, our reverse tax audits can reveal a break down in your accounting system that is resulting in an underpayment of tax and we can help minimize the impact of this mishap and help recommend proper procedures moving forward.
More Resources for Your Business
After we determine that you may be able to get a refund, we conduct a detailed review and analysis of your records. This examination will provide the information needed to substantiate your eligibility and provide the proper documentation to submit your claim. Under the right circumstances, we can provide these services on a contingency fee basis, which means our client pays nothing to initiate a reverse tax audit and we get paid out of the refund proceeds after the reverse tax audit.
Our firm is with you through the entire process, including needed communications with tax authorities or vendors, to the end result of receiving the amounts you are owed. In addition, we work to prevent future overpayments through our planning and consulting actions, so that you have more resources available to your business in the future.
